Ms. Diễm Phương purchased voluntary health insurance (BHYT) under the family household category. Later, she started a job where her employer required her to enroll in BHYT through her labor contract, while her household-based BHYT card was still valid. She wondered if she would lose the money she had already paid for her family-based BHYT.

According to the Vietnam Social Security, Clause 2, Article 13 of the Health Insurance Law states that if a person belongs to multiple BHYT categories simultaneously, they will contribute based on the first applicable category as per the defined order.
The order of BHYT categories is outlined in Article 12 of the Health Insurance Law as follows: (1) The group funded by employees and employers; (2) The group funded by social insurance organizations; (3) The group funded by the state budget; (4) The group receiving state budget support for contributions; (5) The household-based participation group.
Therefore, when Ms. Phương works under a labor contract, she will join BHYT under the group funded by employees and employers.
In this case, Ms. Phương will receive a refund of the amount she paid for her household-based BHYT. The refunded amount will be calculated from the date her company’s social insurance card becomes valid until the expiration date stated on her household-based BHYT card.
This is regulated under Article 20 of the consolidated document 2089/VBHN-BHXH dated June 26, 2020, by the Vietnam Social Security.

To receive the refund, the Vietnam Social Security advises: “Please contact the local social insurance office where you enrolled in BHYT to receive guidance on filling out the Declaration Form for Participation or Information Adjustment of Social Insurance and Health Insurance (Form TK1-TS) to process your refund according to regulations. If you wish to have a family member collect the refund on your behalf, proper legal authorization is required.”
