On February 12th morning, the National Assembly heard presentations and reviewed the draft Law on Amending and Supplementing Certain Provisions of the Law on the Organization of the National Assembly before discussing its contents in committees.
One of the key new provisions is the proposal to add regulations regarding the suspension of duties and powers of National Assembly deputies.
Le Quang Tung, Secretary-General of the National Assembly, stated that the proposed addition aims to concretize Directive No. 148 issued on May 23, 2024, by the Politburo, which specifies the authority of leaders to temporarily suspend work for subordinates when necessary or in cases of serious violations of Party rules or state laws.

This also ensures compliance with Directive No. 41 issued on November 3, 2021, by the Politburo, regarding the dismissal and resignation of officials.
The draft law clearly states that the Standing Committee of the National Assembly will consider and decide on the suspension of duties and powers of National Assembly deputies in two specific cases.
Firstly, if a deputy is indicted as a suspect.
Secondly, during the process of examining and handling violations by a deputy, there is evidence suggesting that disciplinary action from a warning upwards must be taken against the deputy who is an official, civil servant, or public employee, or criminal legal action is required, with relevant oversight, audit, investigation, prosecution, and court authorities recommending the suspension of the deputy’s duties and powers.
Deputies can resume their duties and rights, and regain any legitimate benefits, once competent authorities make decisions or conclusions that there were no violations, no disciplinary actions, investigations are discontinued, or court decisions come into effect stating the deputy is innocent or has been exempted from criminal responsibility.
If a deputy is disciplined, depending on the nature and severity of the case, they may voluntarily resign or the Standing Committee may review and decide whether to allow them to resume their duties or recommend their removal from office by the National Assembly.
The draft law also stipulates that “a deputy convicted by a court ruling automatically loses their status as a deputy from the date the court decision becomes legally binding.”

During the review, Chairman of the Legal Committee Hoang Thanh Tung suggested further scrutiny and codification of Directive Nos. 41 and 148 to provide specific guidelines for suspensions and their consequences to avoid arbitrary application, which could affect the reputation and rights of deputies and staff at National Assembly offices.
In addition to these provisions, the draft law amends and supplements regulations concerning specialized agencies of the National Assembly, the Secretary-General, the Office of the National Assembly, and agencies under the Standing Committee. It also clarifies the division of authority between the National Assembly, the Standing Committee, the Government, and other state agencies.
The draft law is expected to be reviewed and passed by the National Assembly on the afternoon of February 17th.
