Under the Social Insurance Law 2024, individuals who have contributed to social insurance but do not meet the minimum 15-year requirement for pension benefits and are over 60 years old can apply for monthly allowances.

According to the draft Decree detailing and guiding the implementation of certain provisions in the Social Insurance Law 2024 regarding mandatory social insurance, beneficiaries must be Vietnamese citizens who have reached retirement age, have contributed to social insurance, but do not qualify for pension benefits. They also cannot opt for a one-time lump-sum payment or retain their social insurance contributions.

The duration and amount of the monthly allowance are determined based on the length of contributions and the average salary used as the basis for social insurance contributions. The minimum monthly allowance is equivalent to the social pension benefit.

During the period of receiving the monthly allowance, beneficiaries are entitled to free social insurance benefits and funeral expenses, similar to those provided under the pension scheme.

Procedure for Applying for Monthly Allowance

According to Article 24 of the Social Insurance Law 2024, the following steps outline the process for individuals aged 60 or older who do not qualify for pension benefits:

Step 1: Submit the application to the Social Insurance Office. Beneficiaries should submit their social insurance book and a written request for the monthly allowance.

Step 2: Processing of the application. Within five working days of receiving all necessary documents, the Social Insurance Office will process the application. If the application is denied, the office must provide a written explanation with reasons.

Social Pension Benefits

Under the draft Decree detailing the implementation of certain provisions in the Social Insurance Law regarding social pensions, Vietnamese citizens aged 75 or older who do not receive a pension or monthly social insurance benefits may apply for social pension benefits. People from low-income households can apply at age 70.

The proposed monthly social pension benefit is 500,000 VND.

It is estimated that approximately 1.5 million people aged between 75 and 80 will be eligible for social pension benefits according to the Social Insurance Law. This draft decree is expected to take effect from July 1.

Additionally, the procedures for applying, adjusting, and ceasing to receive social pension benefits are outlined in Decree No. 20/2021/ND-CP. For applications, the term “monthly social assistance” has been replaced with “monthly social pension benefit.”

Beneficiaries must use the official application form for social pension benefits as specified in this decree.

For individuals from low-income households, those who turn 70 before July 1 will start receiving benefits from July 1; those turning 70 after July 1 will begin receiving benefits upon reaching 70.

For funeral support services, follow the regulations in Decree No. 63/2024/ND-CP: Registering births, permanent residence, and health insurance cards for children under 6; registering deaths, removing permanent residence, and processing funeral and death benefits.
