This is one of the new provisions added in Government Decree No. 07/2025, which amends and supplements certain regulations related to civil status, nationality, and notarization. The decree took effect on January 9.
Previously, individuals registering for marriage were required to submit an original certificate of marital status. Additionally, those applying for birth registration (in cases where the child’s parents were married) had to present their marriage certificate.
From now on, the Ministry of Justice has confirmed that individuals registering for marriage or birth registration no longer need to submit or present these corresponding documents.

Based on the information provided in the birth registration form regarding the marriage certificate, civil registry offices are responsible for verifying the marital status of the child’s parents through the provincial administrative procedure system, connected to the National Electronic Civil Status Database and the National Population Database.
The civil registry office will verify the marital status of those applying for marriage using the same two interconnected databases.
The results of the verification will be stored either electronically or in paper form, accurately reflecting the information at the time of the search, and attached to the applicant’s file.
In cases where marital status cannot be verified due to missing information in the databases, the Ministry of Justice states that the civil registry office should request confirmation from the local People’s Committee at the commune level where the applicant resides or was married.
To implement Decree 07/2025, the Ministry of Justice has issued an official dispatch requesting provincial and municipal People’s Committees nationwide to instruct civil registry offices not to require the presentation of marriage certificates for parents who have already registered their marriage (except when the child’s parents are foreigners).
When processing marriage registration requests, civil registry offices must not require applicants to submit a marital status certificate or divorce records (for Vietnamese citizens). Instead, they must verify the information through the system.
The Ministry of Justice also requested local authorities to ensure infrastructure and technical conditions, enabling connectivity to receive and process birth registration, marriage registration, and marital status confirmation according to regulations.
